This page explains how copyright owners and DonorSpark users can use the notice-and-takedown process.

Copyright infringement notices

A written notice requesting removal must include:

1. A physical or electronic signature of the copyright owner or authorized agent.
2. Identification of the copyrighted work, or a representative list of multiple works.
3. Identification of the disputed material and enough information to locate it, preferably the exact DonorSpark URL.
4. The complainant’s name, mailing address, telephone number, and email address.
5. A statement of good-faith belief that the use is not authorized by the owner, its agent, or the law.
6. A statement that the notice is accurate and, under penalty of perjury, that the sender is the owner or authorized to act for the owner.

We may send the notice and its contact information to the customer or contributor who supplied the material. DonorSpark responds expeditiously to valid notices by removing or disabling access to identified material.

Counter-notifications

A user who believes material was removed by mistake or misidentification may send our agent a written counter-notification containing:

1. The user’s physical or electronic signature.
2. Identification of the removed material and where it appeared before removal.
3. A statement under penalty of perjury that the user has a good-faith belief the material was removed because of mistake or misidentification.
4. The user’s name, address, and telephone number.
5. The jurisdiction and service-of-process consent required by 17 U.S.C. § 512(g)(3)(D).

We will provide a valid counter-notification to the original complainant. DonorSpark may restore the material 10 to 14 business days after receipt unless our agent first receives notice that the complainant filed a court action seeking to restrain the disputed activity.

Repeat infringers

DonorSpark records copyright notices and counter-notifications and, in appropriate circumstances, suspends or terminates users who repeatedly infringe copyrights. We may also remove material when we have actual knowledge of infringement or when infringement is apparent.

Misrepresentations

Knowingly making a material misrepresentation that content is infringing, or that content was removed by mistake, may result in liability under 17 U.S.C. § 512(f). Consider speaking with an attorney if you are unsure about ownership, authorization, or fair use.
